Terms and Conditions

1. Website Presentation

The website kanel.ch (hereinafter, the "Website") is published by "GGKL CHAPPET", headquartered in Meyrin at 5A rue Emma Kammacher, 1217 Meyrin – Switzerland, operating under the trade name "KANEL" (hereinafter, "Kanel"). These general terms and conditions of sale (hereinafter, the "T&C") aim, on the one hand, to establish the rules for using the Website by any person who visits it (hereinafter, the "User") and, on the other hand, to govern the contractual relationship between Kanel and any User who creates an account on the Website to place orders with Kanel (hereinafter, the "Customer").

2. Website Use and Intellectual Property Rights

By browsing the Website, each User agrees to comply with the T&C in force without any reservation. Kanel reserves the right to modify its general terms and conditions at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer. The user is therefore encouraged, before any use of the Website, to consult the latest version of the T&C published on the Website. All elements of the Website, including images, photographs, texts, logos, documents and others, are protected by intellectual property rights. The User therefore agrees not to reproduce or otherwise use these elements without Kanel's authorization, except for the purposes of using the Website.

3. Subscription

The Customer expressly accepts the principle of receiving or offering a Surprise Bouquet of which they do not choose the shape, dominant colors, or composition. However, the Surprise Bouquet will be made in a style similar to that of the bouquets shown on the Website for illustration purposes. The Customer can also choose between two sizes of Surprise Bouquet: "Generous" or "Sumptuous". Customers whose Surprise Bouquets are delivered on the same date will receive the same type of bouquet, subject to some minor differences. The Prepaid Subscription is taken out by the Customer for a fixed term chosen from the durations offered on the Website at the time of subscription. The price of the Prepaid Subscription is indicated on the Website, including all taxes. The Customer agrees to pay the full price of the Prepaid Subscription in one payment at the time of subscription. It is expressly stated that, as this is a fixed-term contract, the Customer cannot cancel the Prepaid Subscription or obtain a refund (even partial) of its price. The first delivery of a Surprise Bouquet under the Prepaid Subscription takes place during the same month or the month following the month in which the Customer made the effective payment of the full price of the Prepaid Subscription, subject to Kanel's availability. The exact date of this first delivery must be chosen by the Customer at the time of ordering, from the dates offered by Kanel. The date of each subsequent delivery can be chosen and modified by the Customer during the month preceding the delivery month, by email: hello@kanel.ch. If no date is chosen before the first day of the delivery month, the Surprise Bouquet will be delivered on a default date that will be communicated to the Customer by Kanel.

4. Subscription Suspension by Customer/Beneficiary

Any Subscription can be suspended by the customer. In order for the suspension to be taken into account for the coming month, the Customer or Beneficiary must request it via our email: hello@kanel.ch, no later than the last day of the current month. The suspension consists of a temporary halt ("pause") of Surprise Bouquet deliveries for the month following that in which the suspension request was made. It is possible to make such a monthly suspension request several times, up to a limit of 12 consecutive months. If the overall suspension period exceeds 12 consecutive months, the Subscription will be considered terminated, without any refund being claimed by the Customer.

5. Products and Services

The entire selection of flowers presented is not necessarily available throughout the year. Therefore, Kanel reserves the right and freedom to modify the floral composition according to its arrivals. Our florists will respect as closely as possible the resemblance to the image chosen by the customer. We consider that our customers agree with this approach; we cannot accept complaints regarding the modification of the choice of flowers or a slight aesthetic change in the composition. Bouquets ordered from Kanel are exclusive creations, made by highly qualified florists who ensure great creativity. Our assortment is reviewed regularly according to the seasons. All our services are of first quality and freshness. We make daily purchases, both domestically and in Europe.

6. Prices and VAT

The price we indicate on our online store varies according to seasons, market and exchange rates. The exchange rate applied is the current one at the time of payment via "Stripe". The VAT rate applied is that in force in Switzerland on the day of the order. Currently we have two rates in force: bouquets, roses and funeral arrangements are taxed at 2.5%. Arrangements, vases and various materials at 7.7%. In terms of VAT, delivery charges are linked to the product ordered. Any change in the VAT rate will be updated. Kanel reserves the right to modify its prices, it being understood that the price shown in the catalog on the day of the order will be the only applicable one.

7. Legal Capacity

Customers declare that they are of legal age and fully capable of contracting.

8. Order Placement

The information provided by the customer when placing an order is binding: in case of error in the recipient's contact details, Kanel cannot be held responsible for any inability to deliver the product. Orders are only final when they have been confirmed by the customer's payment of the price. After shipment, any modification or cancellation of the order by the customer cannot be taken into consideration and the price paid will not be refunded. Product offers are valid while stocks last. A product that becomes unavailable is marked "out of stock" in the online product catalog. In case of stock shortage, Kanel will contact the customer. They will agree together to deliver a product offering identical characteristics in size and quality to the product initially ordered by the customer.

9. Product Prices

Product prices are indicated in CHF including all taxes. They include VAT and any applicable reductions on the day of the order. Product prices do not include delivery charges (transport). The amount of delivery charges will be specified on the order form before the sale is validated. Products are provided at the price in force at the time of placing the order. Payment of the price is made in cash when the order is placed.

10. Total Payment Security

Kanel ensures total security and flexibility of online payments, by bank or credit card thanks to its payment system entrusted to a service provider specialized in payment security. Kanel guarantees the total confidentiality of your banking information, secured by the SSL protocol, which automatically checks the validity of access rights during your bank card payment and encrypts all exchanges to guarantee their confidentiality. We never know or keep the information concerning your bank card.

11. Delivery

We subcontract delivery to our service providers, depending on the location these may vary. (DPD, La Poste and OVO). In 98% of cases delivery is made on time. In the event that delivery is not made on the day chosen when ordering, Kanel cannot be held responsible. Delivery is made in Switzerland within the expected time by direct delivery of the product to the announced recipient, or in case of absence, by notice of availability (see below for conditions depending on the nature of the product ordered), or by deposit of the parcel in front of the recipient's door in a safe place.

The customer is informed and accepts that delivery may not be made at a precise time, but Kanel commits to make every effort to respect the requested times. Kanel cannot in any case be held responsible for a delivery delay due to a cause beyond its control, including in case of bad weather, disaster, strike, force majeure, incomplete or inaccurate contact details of the recipient or customer, absence of the recipient.

12. Delivery Methods

Your order is delivered within 24 hours throughout Switzerland, with a probability of 98.9%. Deliveries are scheduled from Tuesday to Saturday throughout Switzerland and from Monday to Saturday in Geneva.

12.1 Delivery in the city of Geneva

Monday to Saturday. Same-day delivery possible for any order before 1pm. Our partner delivers by electric cargo bike or using another means of transport that produces no carbon emissions. Only one delivery is possible, the delivery person will contact you if they cannot deliver the parcel. For a second delivery, charges will be invoiced.

12.2 Delivery throughout Switzerland, outside the city of Geneva

Tuesday to Friday throughout Switzerland. In case of absence of the recipient, a second delivery is possible from your delivery tracking accessible from your emails. If delivery is impossible, your parcel will be available at a relay point that you will have selected or the parcel will be left at the recipient's door in a safe place. For each order, our server calculates the closest delivery date and time. You can, of course, choose a later date up to 15 days for most of our flower bouquets. The recipient receives two delivery notifications: One business day before delivery and on the day of delivery with a one-hour time slot. On the "Follow My Parcel" platform, the recipient can track the parcel live and select one of the four available options up to 15 minutes before delivery (grant authorization to drop off, change delivery address, change delivery day, redirect to a DPD Pickup point). Kanel encourages each of its customers to be attentive to the means used to deliver your orders in the best conditions, and to communicate to the delivery person through the application, all important information for the smooth running of this delivery.

12.3 Saturday delivery throughout Switzerland

Delivery of your bouquet on Saturday throughout Switzerland is managed by our partner: Swiss Post. You are delivered on Saturday and you will be automatically informed by SMS or email.

13. Delivery of Your Order

Kanel strongly advises against postponing or changing the delivery address, as these options directly influence delivery times and can damage your flowers. Kanel cannot in any case be held responsible for this decision. The customer can claim reimbursement of delivery charges, excluding any other compensation or damages, for the delivery delay cases below, if the product was not delivered for any cause other than a case of force majeure.

Accuracy of Delivery Address

Please ensure that the delivery address and local phone number on your order are correct and complete. We assume no responsibility for delays or non-delivery resulting from an incorrect or incomplete address. To ensure your order can be processed as quickly as possible, the following information may also be useful:

  • For deliveries to hospitals, the department and room number can be useful. We only guarantee deliveries to the hospital or clinic reception.
  • For deliveries to hotels, we recommend indicating the room number, as well as the name under which the recipient was registered at reception (couple, group, etc.). We only guarantee deliveries to the hotel reception.

Delivery Delay

The customer can claim a full refund of the order if the delay exceeds 72 hours. Finally, if the product was not delivered for any cause other than a case of force majeure, the sale may then be cancelled and the buyer may obtain a voucher for the value of their order, excluding any other compensation or damages. The following are considered cases of force majeure releasing Kanel from its obligation to deliver: war, riot, fire, strikes, accidents, traffic restrictions, snow and the impossibility of being supplied. Kanel will inform the customer in a timely manner of the above-mentioned cases or events. In any case, timely delivery can only occur if the customer is up to date with their obligations to Kanel.

14. Right of Withdrawal

Our bouquets cannot be returned. Any complaint and refund (voucher) of products must be the subject of a formal agreement between Kanel and the customer. The customer may exercise a right of withdrawal without having to justify reasons or pay penalties, no later than 7 days before the delivery date. The above-mentioned period runs from receipt of the order. When the period expires on a Sunday or public holiday, it is extended to the next working day. When the right of withdrawal is exercised, Kanel must compensate (return a voucher) the customer without delay and no later than fourteen days from the date on which Kanel is informed of the consumer's decision to withdraw. Beyond this, the amount due automatically bears interest. Notification of the right of withdrawal must be made to Kanel by email: hello@kanel.ch.

15. Returns and Complaints

Commercial Warranty

Any complaint accepted by Kanel, in the case of an apparent defect or non-conformity of the delivered products, which will be noted by the seller, will allow the customer to obtain free replacement or the return of a credit to their benefit, excluding any other compensation or damages. Complaints concerning orders containing delivered flower bouquets must, insofar as these are fresh products, be made no later than 24 hours from delivery of the product.

16. Personal Data Management

In accordance with the law relating to data processing, files and freedoms, personal information relating to buyers may be subject to automated processing. Under no circumstances do we give your information to third parties and we use it only for the execution of your order. We do not use your information for sending advertising from other companies. With your agreement, we reserve the possibility of sending you a newsletter or information concerning the evolution of our online store, and the activities of our company. At any time you have the possibility to unsubscribe from our newsletters by an unsubscription request located at the bottom of the newsletter. You also have the possibility to delete your privilege account by notifying our sales department. If you forget your password, our server will automatically send you another one. Following your request via our site, Kanel does not have access to this data; usernames and passwords are known only to customers. It goes without saying that all data used to execute your order remains confidential and is in no way transmitted to third parties. By using the Kanel.ch website, you accept the collection and use of your personal data as described in our data protection charter.

17. Customer Service

18. Dispute and Mediation

Complaints or disputes will always be received with careful goodwill, good faith always being presumed in those who take the trouble to explain their situation. Complaints concerning the quality of flowers and plants must be made to our services within 24 hours of receipt of the parcel by the recipient. 19. Archiving – Proof

Kanel will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions in force. Kanel's computerized registers will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

20. Intellectual Property

All elements of the website www.Kanel.ch are and remain the intellectual and exclusive property of GGKL CHAPPET. No one is authorized to reproduce, exploit, distribute, or even use in any way, even partially, elements of the site whether they are software, visual or audio. Any simple link or hypertext link is strictly prohibited without express written agreement from Kanel management.

21. Legal Jurisdiction

We respect Swiss law and apply it in the operation of our company. The legal jurisdiction is in Geneva.
